The fact that mediation is actually taking place is a positive; mediation almost always results in a settlement, although usually at the expense of compromise. The incentive to make mediation a success is the expensive lottery that litigation can be, and where , as here, issues as fundamental as jurisdiction have not yet been decided, mediation can lead to more commercially effective outcomes. Let's hope so.
