Did you mention anything about the draft finding in your email to him? If you didn't and yet he decided to tell you anyway then that would indicate to me that either he himself is following this thread or that he has someone else to do it who then updates him about the latest topic. It has always been my believe that ISX follows this sub forum.

Now to the email that you have provided. First of all I don't know if it is genuine or not but I would give you the benefit of the doubt and would assume that it is.


No one, at least not me, is asking for receipt or content or otherwise per se but instead simply information on whether or not ISX has received the draft finding from the ASX. So that is the information that I am referring to. That particular information does not comprise matters of supposition and neither is it insufficiently definate (SIC). In fact the information would be very definitive in nature. It is either that ISX is currently in possession of the draft finding or do not. So the information does not concern incomplete proposal or negotiation. So based on that, it seems to me that JK is actively avoiding the question for whatever reason. All that he had to do with regards to the draft finding is this, instead of what he allegedly said to you he should have said: "As for the draft findings, yes we acknowledged that we have received such document". That is all that is needed. You either have received it and currently in possession of it or you do not. Nothing incomplete, no supposition nor indefinite. So to me there is no legal nor logical reason to avoid the question if ISX truly want to be transparent and keep the market well informed.



When did the ASX make an announcement that it was seeking to draft findings? Could anyone help me out with this? I am not aware that the ASX has made such announcement, at least not a separate one. Could anyone help me with this? At present I don't think such announcement even exist although I could be wrong.



The question is would ISX? My question to John is, have you received the draft finding from the ASX? I think even you would acknowledge that such document would be very material to everything that is going on and the market deserve to know whether ISX is in possession of such document. No need for the content.
