Table 3 shows litigation initiations, settlements and judgments by type of legal issue. Ten specific legal issues were identified and there is also the category of “other”. For litigation initiations the most common type of legal issue was breach of contract which constituted 32.8% of all cases. This was followed by corporate governance which constituted 15.3% of all cases and deceptive conduct which constituted 13.1% of all cases. Therefore, these three categories of legal issue constituted 61.2% of all litigation initiations. There are similarities when settlements and judgments were examined – breach of contract, corporate governance and deceptive conduct were the three types of legal issues that occurred most often. For settlements and judgments the most common type of legal issue was breach of contract (30.8% of all settlements and 30.4% of all judgments). However, the second most common legal issue was deceptive conduct for settlements (10%) and corporate governance for judgments (14.4%). The third most common legal issue was corporate governance for settlements (8.7%) and product liability for judgments (7.2%).
