No, but from how I understand it while they are lodged and pending, they are still first in the que until such time that they are either formalized and granted, or they lapse. Pfizer were first to the party to lodge a patent on a nasal spray ED drug but couldn't get the chemistry to work so LTR wouldn't have been able to lodge a patent until Pfizer's lapsed. Where patents are concerned, companies are not in a rush to formalize them with the controlling bodies as once they do the patent clock starts ticking, hence why you see a number of designs etc. noting "Patent Pending". Once the patent has expired the secret sauce so to speak, becomes available to the generics much like what happened with Pfizer and Viagra if you look at their market share / sales once the generics came into the market.
