June 2023 accounts .... 18 months late, March2023 quarterly would have been a minimum for reporting - 20mths late - 'being finalised' outright lie as that wording has been used on numberous occasions.
For the current fy 2024 that's mentioned, there's a chance they can argue this doesn't have to be produced as they were removed from the list on 1 March 2024 prior to year-end, however they were still listed for the previous full two quarters (June & Dec '23) - dyor.
The last thing anyone knows (officially reported) was the quarterly up to the end of calendar yr 2022 !
Getting knocked back consistently by ASX...
Imo, blame is being misappropriated there as the ASX 'only' administer the ASIC regulations.
Besides, if a company is consistently denied applications, they would be told just why the denial came about and what was required to rectify this. David Austen knows the regs very very well so there is absolutely no reason why he couldn't have toed the line with applications being above-board, non-ambiguous and totally legal, meeting the ASIC guidelines.
Nah, the 'blame game' is solely on CGB management - and they can try to dance around wording as much as they like but the facts are that they haven't conformed to the regulations that allow them (and our investment in them) to operate as a going concern, declare their financial status for the regular periods, and behave in such a manner that casts an air of disprute over themselves.
It doesn't even look like the QLD court case v Medcan has been resolved yet either. If basic housekeeping such as paying your bills isn't taken care of, and be taken to court for this, you got no business being at the head of even a candy store.
ASIC/ASX might (as they should) have also taken this situation into account when assessing an application by directors to make any kind of legal acquisition.
Misdirection and secrecy is still prominent here, imo.
