ETM have a funding arrangement in place with their lawyers for arbitration. No win, no fees. But this agreement was jeopardised by ETM appealing to Greenland courts. If the arbitrators dismiss the case because the matter is now before the Greenland courts, this could be grounds for lawyers to claim costs from ETM.
This is not the case with litigation in Greenland courts. ETM will be paying those costs.
