Was in coal industry.. coal industry and unions (they went to him and represented him from the sounds)..
I read through article employer gave him a work roster for 12 months ahead with set shifts which was a mistake.
Had the same roster for 3.5yrs or something. another mistake.
Employee was paid above award rate and 25% loading on top to cover annual leave/sick/personal.
is this double dipping? judge says no.
however to give him set 12 month roster big mistake in the end.
Terrible timing for this to happen when the employment market struggling.
