Yes, AKP is still a listed public company and is required to give 28 days notice of the AGM. (S249HA)
ASIC may grant an extension of time for a public company to hold an AGM in very limited circumstances e.g. circumstances outside of the companys control.
I doubt very much a reason such as "we're just waiting to see if our 'fabs' can make our product work" would qualify.
Interestingly, a company in the process of winding up or where it is under administration, can apply for an exemption to holding an AGM.
Even more interesting, the AKP website seems to no longer be available. Guess they couldn't afford the hosting bill.
