The tax rebate isn't 43.5%, but an offset rate of 18.5% based on the company's tax rate. This was introduced in 2021 and replaced the original 43.5%. https://www.ato.gov.au/business/research-and-development-tax-incentive/about-the-r-d-program/
Also, since it is a tax offset, they still have to spend the $5Mil to be eligible, so a cap. raise is very likely.
