I believe the issue was about access , nothing to do with custodial land rites.
In this Country if a landowner and prospector can not reach agreement on payments or access , an administrative tribunal decides , if that fails orders can be made to allow access ,this is generally a last resort.
I can quote a number of cases where landowners have blocked prospecting and have had Courts make a ruling.
