Rodan has an application for the licence in with the regulator, via his company Australian Contract Mining (ACM). That application is ahead, in terms of priority, of the application for renewal by Summit (which itself is both separate and different to the court review of the regulator's decision not to renew the EL1093). Rodan has been bankrolling Summit as he is both a substantial creditor of and has invested a lot of money in Summit and Indochine. If he can't get access to the licence via winning the judicial review (which seems unlikely) then his intention is to pick the EL up for himself via ACM ...
