True but if the first case is won then the 2nd case is held in front of new people who might be more sympathetic to KDR (ie a 2nd chance to reduce the compensation) they will also not have been in court during the evidence stage and thus will only be viewing the reported facts, not the conduct or anything else that went on in court during the case, to me this is a big win for KDR today, I know why MZN were fighting the split.
