Why would they waste money to defend the charges. Just cut a deal that doesn't stuff ASIC around, cop it on the chin for being slimy worms, Doc moves aside for a while, and we get on with it.

Announcing orders were placed when they were not is not misleading and deceptive conduct, it's blatant fraud. It's clear they haven't been able to convince ASIC otherwise or this would not be happening now. Heres's the oder... tick... Nope, they couldn't show anything as simple as that. This is about the Doc's ego again. He should limit the impact to the company by apologising, setting the record straight, taking his punishment and letting the company move on.

The efficacy matter is a little less clear cut. It wasn't effective then but it was later proved to be. Still, he made the announcement without having the evidence to show for it and that's the wrong here.
