Yep, sorry my bad, you are correct and the CEO can't vote his shares.
However, the Board and their controlled entities own circa 15%, so they just require another 8% to get the vote over the line. Hard to believe that given these shares traded at 70c earlier this year, that most shareholders won't support a cash bid at $2.21.
Again, happy to entertain any further bids, but absent other offers, I'd imagine this deal closes.
