Michael i guess we need to disagree on what the implication of non binding terms sheet means. The fact BYE is holding out to receive additional terms sheets suggests they are not entirely happy with the terms sheet they have received to date.
Not sure how relevant you turning around a finance deal in a week (unless its O&G related) is to a likely $40M transaction ($20M refi + $20M additional debt).
