BRL will pay L&M $40m (us) either late this year if they lose the case or in 3 or 4 years if the win the case (ie when escarpment produces it first million tonnes). If they lose the case the costs and interest will represent the only additional burden on the company otherwise not accounted for in the agreement with L&M

This court case only affects the timing of the payment

One of the most telling points of attending the AGM was when RT signalled his positive sentiment about the court case and deferred to our auditors representative who seemed to echo his sentiment.

I have still not quite reconciled this in my own thought processes but it resonates loudly with me whenever the court case subject is brought up and dusted off.

If this volume surge continues things look to be turning
