As I suspected although a lump sum contract there was a significant change in the scope of works and also delays caused by Decmil. The arbitration process is now in the final stage and assessment will be completed under the “General Conditions of Contract” I would expect SXE will be substantially successful.
The issue is whether Decmil has the resources to pay, if not it may be possible that RIO has liablility.
