There is a difference between his being reinstated as a staff member vs to the board. It's my understanding that his claims for unfair dismissal were about his employment as MD, rather than his removal as a board member.

On a slightly different point, if JH proves defamation against Askin and Dunmoore in their comments regarding his removal from the board, could it be argued that (alleged) false statements by them resulted in a worse vote for him, and that he might have retained his board position if they hadn't made these (alleged) false statements?
