Tyro have a duty to disclose this information as it became aware of it due to the continuous disclosure requirements... now, It's up to the market to assess the risk.
As it has only just been filed, Tyro has yet to be served - receive formal notice - but that is simply an administrative process to establish court hearing dates etc, etc..
However, you can be assured that both lawyers would have been negotiating prior to and would still be negotiating to try and find resolution. See my comments above as to my estimates of the risk.
