Again, you're kinda disagreeing with Justice Davies here.
She found that there was a question to be tried about whether the report was accurate. She found that there was not a question to be tried around whether ASX held their position honestly and in good faith. She found that there was not a question to be tried around a breach of duty.
So saying "it's not a matter of whether ASX's findings were accurate ... it's who determines what's right" is already dealt with in court. It was determined that ASX had an opinion and their role gave them to right to form and hold that opinion.
I should point out that "your bias is so strong that it's impossible to change your views"... Unfortunately, the judge disagrees with you, so...
