The conclusion that they cannot rely on the deferal notice is clearly articulated in the legislation ... see this regulatory note. Per RG 174.63 "...A listed company relying on our deferral relief will need to notify the relevantmarket operator. Failure to notify the relevant market operator at the start ofthe deferral period, before the company is obliged to comply with its financialreporting obligations under Pt 2M.3, will result in the company losing thebenefit of our deferral relief...." As previously note, the company failed to construct and assemble various documents due since the appoint of the adminsitrator (July 2023) in which case deferral is not available. https://download.asic.gov.au/media/lx1fvdoa/rg174-published-6-october-2021.pdf
To be honest, my sense is that the administrator has failed at basic administration and this can only heighten concern for the quality of the the balance of his efforts.
I strongly encourage you to reach out to someone if not everybody who will listen. I have no doubt that this company will be privatised shortly and you will get even less information and enjoy even fewer "investment-shelters" than ever. do yourself a favour ... a stamp costs $1.50 (I think) and 15 minutes of your time ... write to anybody who ought to hear about it
