No evidence given/offered as to exactly what marketing was provided. I'd reckon they'd cover it by saying something related to the Paris Expo for skincare products. Half the board are lawers so they'd cover breaching laws anyway.
There are a lot of points in your previous post however which bring into question responsibilities such as acting in good faith with care and diligence and in the best interests of the company. The horse has been flogged to within an inch of it's life on those regulations.
