Contractual liabilities, although relevant in the longer term, are largely academic at the moment. There appears there is not enough money to finish the project, share price is setting new lows, the project is years behind schedule and I would guess massively over budget with no clear end in sight, and now a 166M share overhang has been created that will continue to dampen the share price until cleared. Biggest issue right now is who will put their hand up to fund the company for another year......that's the $6.4m question.
