J.A. did not address the AVZ - Dathomir case regarding the 15%, it was not his briefing.
In his explanation he clearly states, that Dathomir sold 60% of Dathcom to AVZ and that AVZ is the undisputed holder of that 60%. Get a French girl friend and she will help you with your lack of French.
Pretty amazing that you as a non holder, non French speaking individual, spend so much time on a case you hardly understand.
As you seem to be a legal eagle, or want us to believe you are one.
The 15% case of AVZ versus Dathomir......
Example:
If I sell you my house for $1,000,000, contracts signed and sealed, money in the bank, etc, etc, etc.
However, after 18 months real estate values have rocketed and the value of the house is now $2,000,000.
How much chance do I have through a real court (not one which is bought like the one in Lubumbashi) to annul that sales contract, because I believe I am entitled to another $1,000,000, but do not give you a reason why I want to annul the contract?
Do you really think I would be successful, why not ask your legal advisers as well.
However the sales contract between AVZ and Dathomir over the 15% was never annulled, but the Lubumbashi Court decided it had no jurisdiction and the case had to be decided by an Arbitration Court.
It is the reason why AVZ has taken this to arbitration in Paris and are pretty sure they will win.
One has to ask if Dathomir/Cong is silly enough to fight the case.
