I would suggest however if you pay someone $3m and that person uses the $3m to acquire an asset then you either have an equity in that asset of $3m or if it was defined as a 30% prepayment you have 30% equity in the asset.

This is simply the common law doctrine of a constructive trust.


The same applies to any asset. If you give someone 300000 and they buy a house in their own name for $1m you have a 30% equitable interest in the house

If you give someone $3 towards a lotto ticket. They buy a ticket for $10 and it wins you have an interest of 30% of the winnings.

It is fairly easy for Anglo to get their 30% back in the courts if it is not stated in fine print. the courts deal with this all the time
