Would you rather they do a CR just off all time lows?
I would suggest going and having a good read of the announcement, it is as good a deal as they could have struck and has some upside to it is there is any success. Not to mention a 6 month ESCROW, so the driller and the co expect they wont lose off the arrangement I would suggest.
