there have been a number of articles about this, the economist ran one a few months ago
i spoke to LD (and sent him the article from the economist). He was well aware of the issues.
Seems, true to america, that there professional agitators who seek out such issues and pursue litigation
LD seemed confident that the correct procedures and processes would sort it all out
