I don't think you are missing anything. I know that there are some ineligible holders who cannot participate due to their overseas jurisdiction.
I would speak directly to David about reinstatement criteria.
Some people still hold the view that MMR need NOPTA approval to relist as this was once one of the ASX criteria for reinstatement. My understanding is that the ASX have removed this condition. All their other criteria have previously been met. So, as long as the rights issue covers the ASX liquidity requirements, then it should return to trading as per the timetable.
