I'm sure someone will correct me if I'm wrong but I believe it's the ASX which has the final say on whether an announcement is marked Price Sensitive or not.

I recall in another stock I owned a few years back there was a bit of angst amongst shareholders as there were announcements coming out which weren't marked Price Sensitive but the general belief was that it should of been. Later it was confirmed via correspondance with one of the directors and a shareholder that it was the ASX knocking it back and deciding to release them non-Price Sensitive.
