More likely Locke are waiting on further favourable arbitration rulings coupled with the new ministry being sworn in before negotiations with government can proceed.
Otherwise it's completely fanciful to rely on court-imposed penalties being honoured. At best they would serve as a bargaining chip, nothing more.
