it's neutral at best. Locke holds all the power with the exclusivity clause. I suspect they are waiting to see if any of the legal costs are recouped.
I fully expect them to walk away. Unfortunately; getting money out of the parties is going to be very tricky.
re sundance what court / arbitration organisation did they win their case at and has Congo (?) appealed the decision, or they out right, refusing to pay?
