In the game of chess you only have to out think your opponent by one move, surely you don't think they don't have a chance of a favorable outcome? Even if it's 50/50 it's a gamble worth taking to end the saga and I'll be happy to loose my total investment rather than languish in uncertainty.
I'm sure even during arbitration there will be opportunities to resolve the matter.
