The real test will be the broader Cominière Abritration Proceedings before the ICC challenging Cominière’s transfer of 15% of its shares in Dathcom to Jin Cheng Mining, a subsidiary of Zijin Mining, in breach of AVZ’s pre-emption rights within those SPAs.
