The Federal Court found that the AAT misconstrued the definition of 'experimental activities' in making its decision. The Federal Court didn't make any finding (positive or negative) on the company's R&D activities (whilst MRV asked the Federal Court to make a decision on the eligibility of the activities, it refused to do so).

The AAT will now reconsiderthe merits of MRV's activities in accordance with the judgement.

It will be interesting to see how this progresses.
