To me this is simply MC saying he wont make a decision until RIO completes its DD.
If RIO say no, thrn FEX offer stands. Why update your offer if you dont gave to?
Expect a further FEX offer to be issued if RIO starts making unconditional noises in 6 to 7 days IMO of course.
Sit back and wait me thinks
