Didn't think I would have to explain but here goes.
Until the decision is handed down either way there is no certainty so its a problem.
If I were lending CNE money and there was a, no matter how silm possibility several hundred million in back taxes could land I would want certainty before lending.
The asset the Indians froze is worth FAR less than the tax bill.
I think CNE should win simply because the tax is retrospective......but arbitration will decide.
