The other interesting thing from the link is that it suggests they are in mediation and not court proceedings. This suggests ASIC may be willing to accept an Enforceable Undertaking from the Doc and negotiate a deal. It can include ASIC accepting certain enforceable undertakings (legally binding promises) from the Doc to do better in future and be bound by the promises he makes for a period of time before he is released from them if they are satisfied he has complied.
