I am basing my opinion that the bank would have known about the SLBC prior to accepting the loan. WKT did not need to have it in place when signing the agreement ie WKT wasn’t required to pay for it until it was required, just before draw down. That is why it was a condition that wasn’t met when signing up for the loan.
I find this a very irrelevant point you are trying to make when Gemcorp has now funded the project and drawdown has commenced.
