Cujo i am sure you are right both sides will have a list of information requests some relevant some not but its all part of the process/game to position them selves as the innocent party and that they did anything wrong. 

We are getting to focused on literal points (by the way we actual have no idea of whats actual going on) rather than what this is which is a game of poker.  FAR may or maynot have a great hand but COP have deep pockets and WPL (involved or not!) are showing commitment since the sale/purchase by pushing forward. 

My view is it is unlikely any party will "win" regardless of the legal position as this is arbitration and by the nature of the beast is their to "find a solution" or compromise taht all parties will sign up to when at the 11th hour plus.
