I agree Mr Hustler -why would COP put at risk $430m transaction by not offering pre-emptive.
logic would suggest they think they didnt have to, or had done a process compliant with relevant agreements - which goes back to far trying to buy more time legally - not bluffing but believ it was worth a shot to try and extract more time or value from the pre-emptive right or have another go at pre-emption-
just speculating of course
