Kin/Delphi buying 10% put the price up and stopped takeover acceptances cold, I guess.

Keeping the offer open now just looks kicking the can down the road to avoid announcing takeover has failed. I am probably not the only who bought recently as a bet there will be 2nd attempt at a much better price, for the remaining shares, after 4 months.

The Board is another matter. They have to proceed on the basis the takeover failed.

The potential conflict of interest is that GMD would prefer the DCN MC be as low as possible if they make a second TO bid. The board's job is to make it as high as possible. It is interesting Kin/Delphi haven't sought a board position (unless they have).
