What is actually going on here is a gamble by BGC hoping to pin the blame for the leaks on the manufacturer rather than the supplier or installer (themsleves).
If they were to win then they would bolster their business through remedial work AND avoid any liability for claims over defective installation leading to the failures. On the other hand if Fletchers can show the pipe wasn't defective but improper installation was the cause of the leaks then BGC might be heading for bankruptcy.
In due course, if Fletchers has sufficient evidence to refute the claims then this will likely end up in court.
