We can not have a negotiated settlement and a TAFTA ruling. We can, however, keep it active as an insurance policy. However, we MUST reach an agreement with them around all the other items. BOI incentives, royalties, tax holidays, or anything else. The problem is that it has been a whole year since KCN announced they were "close to a deal."
