surely APRAs actions were all about appearances. They thought they had a slam dunk case against Kelaher in light of the rc, with the public (read ‘media’) opinion behind them, which would show that they were strong, and happy to proceed to court.

My understanding is that remediations relative to fees for no service fall within the remit of the ASIC, not of the APRA (see link below).
