I thought the Panel would look at whether control effects give rise to UC in the context of a CR, or a bid, or where there are undeclared associates. There's no CR or bid. The recent Sovereign Gold decision shows how hard it can be to demonstrate association that falls within the scope of that term as defined.

I have my doubts that the Panel would be interested in anything arguably controversial around 253E - I suspect they would consider that a matter for private civil litigation. But, the IOF decision shows they will at least have regard to 253E in the context of a wider issue, so maybe that does create scope for an application if the Wang bloc is improperly voted. Maybe we will soon see!
