the key is for management to extract another bid or get the price well above 40 on their own back. the longer the price stays below 40 the more people will be enticed to accept 40 from LB. If LB made their bid unconditional and offered payment within say 2 weeks, I bet they would get a decent amount of acceptances. No way am I locking up my shares by signing their paperwork, when payment could drag on for months...
