NWF 09/12/2014 16:45 GENERAL PRICE SENSITIVE REL: 1645 HRS NZ Windfarms Limited GENERAL: NWF: Court of Appeal Judgment NZ Windfarms Limited (NWF) advises that the Court of Appeal has today delivered its judgment on the appeal by Palmerston North City Council (PNCC) against an earlier decision by the High Court. The Court of Appeal has dismissed PNCC's appeal and affirmed the High Court decision, which set aside declaration 1.9 by the Environment Court. Declaration 1.9 held that NWF was in breach of its Resource Consent for the Te Rere Hau wind farm by failing to build turbines generally in accordance with its original Application for Environmental Effect. The effect of the Appeal Court decision is to refocus the parties on the Environment Court process. The parties are waiting on a decision from the Environment Court related to declarations sought by the PNCC on compliance with the specific noise conditions of the consent. A three day hearing was held in October and a decision is expected in early 2015. The Chief Executive Officer of NWF, Chris Sadler, said NWF remained committed to work with the Council and the local community to constructively resolve issues concerning noise - rather than to engage in further litigation, and would again seek discussions with PNCC on options for resolving the outstanding matters.
