HIGH COURT GRANTS LEAVE TO APPEAL TO THE COURT OF APPEAL
In a decision released today Justice Williams has granted the Palmerston
North City Council leave to appeal to the Court of Appeal regarding his
earlier decision to set aside Declaration 1.9 issued by the Environment
Court. This Declaration stated that NZ Windfarms Limited ("NWF") was in
breach of its Resource Consent.
NWF remains confident of their position and will contest the Appeal to the
Court of Appeal. This Court process notwithstanding NWF is continuing to
monitor the sound levels received by local residents in order to prove
compliance with the existing consents.
