From memory there were posts at the time of the Deed with ITOCHU suggesting the DSRs and Options would only be taken up if we won back the 75%.

But they may be taken up whether we win or lose (10% discount to the 2m VWAP commencing 1m after Final Determination (end of legals). ...

We're holding $20 million in trust. If they should choose to exercise their rights within the 6 month period. .. well ... that would/should help pay our legals :-). I can feel GA's predator hovering overhead, our bank balance in their sights - and ITOCHU stalking the SP alongside the court orders
