    *sorry what I meant was that given ISX has spent a cool ~1.9m on legal fees in the last half, its not a stretch that given the ASX case is 18 months old and the ASIC case nearing one year, that both ASX and ASIC together have spent over 5m. ASX has had to respond to 4 SOCs, discovery, numerous hearings all the while using a QC no less, and it hasn't even reached trial! Imagine those bills for a QC and junior lawyers each day at trial!

    Imagine the billable hours for both sides just in the last few weeks, combing through rheems of discovery and now drafting claims and defenses. ISX only has 10m in the bank, and if and when this comes to a head and if ISX lose, if it loses badly, the court will award costs to ASX and ASIC.

    That's distasterous and something approaching a question of solvency. Obviously with the demerger plan just leaving a shell thats all fine, but is that seriously going to be allowed by ASIC? We will wait and see if and when it is approved by shareholders...
